Mashpee Town Hall Meeting Room 1 & 2

Commissioners Present:  Jack Fitzsimmons (Chair), Ralph Shaw (Vice Chair), Lloyd Allen, John Rogers, Jeff Cross

Staff Present:  Drew McManus (Assistant Conservation Agent)

Jack Fitzsimmons called the meeting to order at 6:55 p.m.

Pre Hearing Items:

1. Approving Minutes from 5/17/07
Jack made comments on the minutes of 5/17/07: commentary by the commission on the matter of the gap existing between the revetment walls of Cariglia and Baudanza on Triton Way should be added into the minutes.  The minutes reflected discussion of the revetment walls but not in detail about the existing gap.  The agent told the commission that the commentary will be added into the minutes of 5/17/07, after which, the minutes can then be approved at the hearing on 6/14/07

2. Baudanza/Cariglia
The commission had brought up concerns about the gap between Cariglia and Baudanza’s revetment walls.  Jeff Cross had inquired as to what needs to be done to expedite the process of completing the revetment walls and replanting the easement on Triton Way.  The agent reassured the commission that he would make the necessary phone calls and contacts to get some clear answers on what the status is for this project going forward.

3. Larkin Property
Lloyd Allen brought up the subject of a parcel of land offered up for sale by Mr. Larkin on the corner of Route 151 and Old Barnstable Rd.  The commission was unsure as to the asking price for the parcel as well as what type of resource area, if any, the parcel encompassed.  Jack mentioned that Tom Fudala (Town Planner) was trying to change the zoning in this area…currently it is zoned for commercial usage.

4. Peggy Fantozzi’s Bog Reports from 06/07
Jack asked the agent to get the observation of maintenance reports of the Quashnet Bogs from 2006-2007 for the purposes of AFCEE and the clean up effort.  The agent told Jack he would have the reports by the next meeting.






Hearing Agenda:

7:00 p.m. 260 Heath Street Realty Trust (NOI), 16 Popponessett Island Rd- Construct and maintain a pier, ramp and float
Mike McGrath (Holmes and McGrath) represented the client and described the project.  Jeff Cross had asked about the length of the pier, and Mr. McGrath told him that the length had been extended beyond allowable limits by the Harbormaster for the purpose of reaching a water depth beyond 2 feet so the prop wash from the boat propeller will not have any adverse effects on the ocean floor.  The agent asked Mr. McGrath about a stairway shown on the plan that allowed for access from the boardwalk to the sandy beach in front of the revetment wall.  The agent stated that this staircase is not mentioned in the project description for the NOI nor is it mentioned in the narrative, therefore, it cannot be approved at this meeting.  Mr. McGrath told the agent/commission that Holmes and McGrath will file for an amended order to include the stairway.

Motion made, seconded and unanimously carried to close and issue

Meeting adjourned at 7:45 p.m.
